factory. The man is not a certified lunatic. The doctor's

certificates merely state him to be an incurably feeble-minded

and degenerate person and recommend his detention in the Mental

Ward. The Judges of H. M. Supreme Court have however decided

that they have no authority under Section 102 of the China Order-

in-Council, 1904, to enforce the provisions of the Mental

Deficiency Act, 1913, and have stated their inability to give an

order for the detention of Livesey, which is therefore not

strictly legal.

Moreover, Livesey has already been a patient at the

Nursing Home for over 4 months and the rules of the Municipal

Council in regard to the Mental Tard insist on removal after 6

months. There is no other institution at Shanghai where such a

case can be cared for.

Though apparently not a lunatic, the man is incurably

mentally deficient and degenerate, and is a constant source of

trouble and expense in this port, to which he does not belong. It

is not possible to send him to the United Kingdom, since H. M.

Judges have decided that they have no jurisdiction under the

Mental Deficiency Act of 1913.

In view of the above stated circumstances and the

fact that Livesey is a native of Hongkong and the son of a man who

was apparently formerly employed in the Hongkong Police, it seems

to me that his maintenance is properly a charge on Your Excel- lency's Government, and I would be glad to learn whether or not

they are prepared to defray cost of same. The only alternative

is to send him back to Hongkong, his place of origin, and where

he could presumably be more satisfactorily dealt with than he can

be here under existing legislation.

The difficulty of delging with mentally deficient persons, who are not natives of Shanghai, in this port, has become so great that I propose shortly to place the whole matter before

His Majesty's Government.
